The Metaphors of Contract Law: Reflections on Corbin on Contracts

Dr. John E. Murray, Jr. has authored biannual supplements to the Corbin on Contracts multi-volume treatise for several years. He is also the author of revised volume 9 of the treatise dealing with third party beneficiaries, assignments and joint and several contracts. At the request of Lexis publishing, he authored the recently published single volume Desk Edition of the 89 chapters of the Corbin treatise. In this presentation he will consider certain aspects of the Desk Edition with particular focus on the 21st century accuracy of some of the classic metaphors of contract law and their application in modern case law. |

Enlightened by the Scots: The Search for American Constitutional Rights

This presentation concerns one of the most confounding areas of Constitutional Law: the effort of the United States Supreme Court to develop a sensible methodology to identify fundamental Constitutional rights that are not explicitly set forth in the text of the Constitution. The material will suggest that the doctrines of selective incorporation, substantive due process and the effort to find the “other” rights referred to in the 9th Amendment has resulted in a jurisprudence based on circular reasoning and the arbitrary use of tradition as a substitute for a principled analysis. The presentation will conclude with the suggestion that the roots of a principled analysis may be found in the source of intellectual thought that was so profoundly influential on the authors of the Constitution: the Scottish Enlightenment. |

Before Dallas: The Clergy Child Sexual Abuse Crisis

Dean Cafardi will give a broad overview of the canon law of the Roman catholic Church, focusing on the Church's criminal laws. He will explain how these laws could have been used to defuse the Church's growing sexual abuse crisis. He will also examine how the bishops did address the clergy sexual abuse crisis, primarily through therapeutic treatment centers. The presentation will be based on "Before Dallas" Dean Cafardi's often-cited work on the clergy child sexual abuse crisis. |

Immigration Law: Religious Workers

As the number of foreign-born Catholics immigrating to the United States continues to steadily increase, the number of U.S. men and women entering the seminary or religious life continues to steadily decrease. In light of this reality, the Church is bringing foreign-born religious workers into the U.S. to address the growing need for spiritual and pastoral ministry to foreign-born and U.S. Catholics.
This training will offer: basic concepts of immigration law, applicable laws and regulations. The specific focus of the training will be on Religious Worker Visa’s. Topics will include current issues in new regulations and litigation.
The Center for Religious Immigration and Protection represents over 250 Diocese, Archdiocese and Religious Communities in the United States. |

Beyond Words: The Nonverbal in Communication

Prevailing research shows that 93% of any act of communication is nonverbal. In highly verbal/ intellectual professions such as the law, focus tends to be almost exclusively on the correct words to carry the message. In actuality the successful transmittal of the message relies almost completely on the how of the delivery.
Highly experiential in design, The Nonverbal in Communication class will help participants increase their familiarity with the non-verbal aspect of communication, including gender disparity, acquire techniques to improve each individual's nonverbal habit of communication and teaches a system that helps in understanding the nonverbal cues we see from others in every act of communication. |

All programs listed in the Sciullo Series will be held in Room 203 at the Duquesne University School of Law on Saturdays from 9:00 a.m. to 12:15 p.m. Registration will begin at 8:30 a.m.
